Privacy Statement for California Residents

In addition to MSA’s Privacy Statement, this Privacy Statement for California Residents provides supplemental information specific to residents of California. California laws, including the California Consumer Privacy Act and any amendments or adopted regulations thereto (“CCPA”), require that MSA Safety Incorporated and its subsidiaries (collectively, MSA, “we,” “us,” or “our”) provide certain information to California residents about how we handle their “personal information” that we have collected, whether online or offline.

Privacy Notice at Collection: Categories of Personal Information that We Collect, Disclose or Sell

The table below identifies categories of personal information about California residents that we may have collected or disclosed for a business purpose, as well as some supplemental information. Please see other sections of this Privacy Statement for additional information about our practices and your rights.

MSA retains this information consistent with our records retention policies and, in any event, no longer than is reasonably necessary.

Basic Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers. We may collect your telephone number or signature as a business representative that purchases a product or service from us use your information to provide your company with products or services, to identify other products and offers that may be relevant to you, and for other business purposes.
Characteristics of protected classifications under California or federal law such as race, color, sex, age, religion, national origin, disability, and citizenship status. We may use this information for our equal employment opportunity program, to determine your eligibility under export control regulations to receive certain information, and for other business purposes.
Commercial Information such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We may use your information to provide you with products, to identify other products and offers that may be relevant to you, and for other business purposes.
Biometric information such as voice recordings, fingerprints, retina scans, or facial recognition. We may use this information in connection with providing products and services, such as voice recordings as part of our customer support, trainings, legal compliance, and for other business purposes.
Network activity information such as browsing history, search history, and information regarding interaction with an Internet Web site, application, or advertisement. We may use this information to improve your experiencing browsing and purchasing our products, to better understand the visitors who comes to our website and what content is of interest to them, and for other business purposes.
Geolocation data. We may use this information to provide our Safety io services as well as improve the quality, security, and relevance of our website experience, and for other business purposes.
Sensory Information such as audio, electronic, visual, thermal, olfactory, or similar information. We may use this information to personalize your experience with us, and for other business purposes.
Professional or employment-related information, such as corporate service dates, emergency contact information, and job information. We may use this information to conduct research on how to improve our products and services, and or for other business purposes.
Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, 34 C.F.R. Part 99). We may use this information to conduct research on how to improve our products and services, and or for other business purposes.
Inferential information drawn from any of the information identified above to create a profile about a resident reflecting the resident’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes, etc. We may use this information to personalize your experience with us, and for other business purposes.
Note that the table above does not include information publicly available in government records, de-identified or aggregated California resident information, or information excluded from the CCPA’s scope, such as health or medical information coved by HIPAA or personal information covered by certain other privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994. In addition, this list is not exhaustive for employees, applicants, and/or contractors in California, which is governed by a separate notice that such persons can access by making an information request with our Privacy Center

Sources of Personal Information

We may obtain the categories of personal information described above from the following categories of sources:

  • Directly or indirectly from you, your devices, your employer, or your agents. For example, from documents that you provide to us or from forms that you fill out, such as registering to attend a webinar or signing up to our marketing list.
  • Directly or directly from the use of our products, services or platforms, such as location and device data (including tracking tools like browser cookies and mobile device IDs).
  • Directly or indirectly from activity at our facilities or on our website, intranet, MSA systems or MSA-issued or approved devices. For example, from submissions through our website portal or website usage details collected automatically.
  • From other sources, such as business customers, business partners, vendors, governmental authorities, and information publicly available on websites

We also may combine information. For example, we may combine information we have collected from our products with information that we have from our marketing systems or other platforms, whether offline or online.

Uses of Personal Information

We may use or disclose the types of personal information described above for one or more of the following purposes:

  • To administer or website or other online service.
  • To communicate with you or your company (marketing or non-marketing). For example, to provide email alerts and other notices concerning our company, products, or services, or events or news, that may be of interest to you.
  • To provide or improve a product or service. For example, our Safety io Grid service allows customers to monitor geolocation of portable gas devices in real time, which may or may not be assigned to particular workers.
  • To create, maintain, customize, or secure your account with us.
  • To facilitate transactions. For example, for shipping, delivery, or distribution, or to make or receive payments.
  • As part of ordinary business processes. For example, as part of Human Resources processes.
  • To improve internal processes. For example, to improve our website and better present its contents to you.
  • To personalize your website experience and to deliver content and product and service offerings relevant to your interests.
  • In connection with certain business transactions (e.g., financial institutions, government entities, shipping companies), such as acquisitions or diverstitures.
  • For feedback, research, analysis orand product development.
  • For customer support and/or responding to inquiries or concerns of any nature.
  • To enhance the safety and security of our business, facilities, website, products, platforms, or services.
  • In connection with legal proceedings.
  • As necessary or appropriate to protect the rights, property or safety of MSA, our customers, or others.
  • To verify your identity to prevent fraud and other unlawful activity, unauthorized transactions, claims and other liabilities, and to manage risk exposure.
  • To conduct investigations and comply with and enforce applicable legal requirements, relevant industry standards, contractual obligations and our policies and terms.
  • In cooperation with law enforcement or as required (or permitted, when acting in good faith) by law, or permitted by applicable law,by court order, or regulation.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.

We will not collect additional categories of personal information or use previously collected personal information for materially different, unrelated, or incompatible purposes without providing you notice, except as otherwise required or permitted by law.

Disclosures of Personal Information

MSA may may disclose some or a portion of the personal information described above to service providers and business partners (e.g., distributors) for fulfilling a contract or to sell you or inform you about MSA productsvarious third parties. In addition, MSA may provide personal information to vendors, consultants, marketing partners, research firms, and other service providers or business partners for the uses described above. These include:

  • MSA Safety Group affiliates
  • Select business partners (e.g., relevant distributors)
  • Cloud storage providers
  • Payment processors and facilitators
  • Research providers
  • Consultants, lawyers, accountants, and other professional service providers
  • Law enforcement and government entities
  • Data analytics providers
  • Background check and identity verifications providers
  • Marketing partners and marketing platform providers
  • Vendors that assist MSA in transporting or distributing our products
  • Vendors that assist MSA in enhancing safety and security of our products, services, or websites
  • Successors to all or any part of our business

Such disclosures may be made to service providers who use the information in compliance with our instructions, to companies and individuals as necessary to facilitate the operation of MSA’s business, and to other entities, such as government authorities, as required or permitted by law. For example, MSA may disclose certain personal information as part of due diligence, or as necessary to make or receive payments for goods or services or to actually provide our goods or services. MSA seeks to limit disclosures to only the information necessary to fulfill the legal or business purpose for which the information is being disclosed.

Personal Information that MSA Sells or Shares

MSA does not sell your data for money – we are not data brokers, and we don’t put your data on the open market. However, under California’s privacy law, sharing of personal information necessary to provide you with personalized ads may be considered a “sale,” even if no money is exchanged. If you want to opt out, please complete a “Do Not Sell” request at our Privacy Center.

If you opt out, MSA will stop sharing your information with some of our advertising partners, as well as sharing your contact information with our distributors (if applicable), and you will no longer receive personalized offers from MSA on some sites or services.

California Resident Rights2

California law grants certain rights to California residents and imposes restrictions on particular business practices. Depending on their relationship with MSA, a California resident may have the right to make the following requests:

Deletion: The right to request deletion of personal information that we have collected about them, subject to certain exemptions.3

Right to Correct: The right to correct personal information that is inaccurate.

Right to Know: The right to request that we disclose information about how we have handled their personal information in the prior 12 months, at no charge, up to twice in a 12-month period, including a copy of such personal information if requested, including the:

  • Categories of personal information collected;
  • Categories of sources of personal information;
  • Business and/or commercial purposes for collecting and selling their personal information;
  • Categories of third parties to whom we have disclosed or with whom we have shared their personal information; and,
  • Categories personal information that we have disclosed or shared with a third party for a business purpose
Submitting Requests.

A request to exercise copy, deletion, “do not sell,” or right-to-know rights can be submitted via intake form at our Privacy Center the below form, mailing a letter to MSA Safety Incorporated, 1000 Cranberry Woods Drive, Cranberry Township, PA 16066, Attention: Law Department, Privacy, or by contacting us at 1-800-532-9762 (toll free). We will attempt to respond to a California resident’s verified request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding our receipt of the verified request.

Verification.

We cannot respond to your request or provide you with personal information if we cannot verify your identity and/or your authority to make the request and confirm the relevant personal information relates to you. We will only use personal information provided in a California resident’s request to verify the requestor’s identity and/or authority to make the request.

If you wish to use an authorized agent to submit a request, we will need valid documentation (e.g., notarized power of attorney) to verify the authorized agent by confirming that the original requestor has given written permission. We may deny a request from an agent that does not submit proof that they have been authorized by the consumer to act on their behalf.

Incentives and Non-Discrimination.

MSA also does not discriminate against individuals for exercising their rights under the CCPA. However, we may offer you certain financial incentives permitted by the CCPA that could result in different prices, rates, or quality levels. Participation in any such financial incentive program can be revoked by you at any time.

Other California Rights.

California’s “Shine the Light” law permits users of our Website that are California residents to request certain information regarding our disclosure if personal information to third parties for their direct marketing purposes. To make such a request, please visit our Privacy Intake Center and note “Shine the Light” in your request description.

Changes to Our Privacy Policy

This notice is not an agreement. We reserve the right to amend this Privacy Policy at our discretion and at any time. To ask questions or comment regarding this Privacy Policy, please contact us at our form on the Privacy Center and indicate that you wish to make an “Information Request.” Your continued use of our Website constitutes your acknowledgment and acceptance of any such changes.
